What should be an application for employment at an individual entrepreneur sample filling in 2019? Despite the fact that an individual entrepreneur in the economic field acts as a businessman working "for himself", he may express a desire to hire people or get a job as an employee. In this regard, employers have a question, is it possible to do this, and how to document the admission of a citizen to a position?

An individual entrepreneur who wants to get a job is not always required to write an application.

The law states that this action is mandatory in two cases:

  1. When an entrepreneur goes to work in a government agency.
  2. When applying to a municipal organization.

For other situations, the application is not required, although it can be drawn up. The employer decides whether to write it or not; technically, there is no need to draw up an application, since labor relations are fixed in the concluded employment contract. Case studies show that many managers require this document to be written.

An individual entrepreneur, getting a desired job, writes a regular application for admission. There are two options:

  • document in free form;
  • in the form established by the organization, sometimes on letterhead.

The application form for admission is not strictly prescribed, but usually contains a "header" with the name of the head and the name of the institution (if applicable), the name of the applicant, the word "Application" and a request for admission. The paper is endorsed by the signature of the applicant, and the date of compilation is put on it.

It is important to know that any employer has the right to hire an individual entrepreneur, even if he himself is an individual entrepreneur. If there is a device to an individual entrepreneur, in this case, an application for employment to an individual entrepreneur is written.

Being an official action, hiring in an individual entrepreneur or a legal entity is necessarily accompanied by the signing of an employment contract. This is a fundamental document describing the relationship between an employee and his employer.

At the same time, its compilation is preceded by the following actions:

  1. Submission of an application (the procedure is mandatory for budgetary and municipal structures). Filling out a work book

An application for employment of an individual entrepreneur has been submitted, documents for admission have been submitted, and a decision has been made: the employee has been accepted.

After that, the employer is obliged to enter the relevant information in the work book:

  • information about the organization;
  • full name of the employee;
  • position;
  • date of admission and its basis.

This is done only when formalizing a contractual employment relationship. If a civil law contract was concluded, information is not entered in the book.

If a person does not have a book, then the employer is obliged to get it for the employee. An entry in the work book is also made by the employer. In the case of a new workbook, its title is filled in and information about the position and place of work, the date of admission and the basis for it (order) is entered under serial number 1. The entry is endorsed by the signature of the employee and the seal of the individual entrepreneur. When working part-time, an employee may, if desired, ask to make a note about the second job in the labor force.

An important nuance of the labor code is the prohibition of hiring an individual entrepreneur to work for himself: entrepreneurship is not considered work by law, and such a step is unacceptable.

All documentary formalities are settled, but after signing the papers and registration, the hiring is not completed until the information about the employee is submitted to the state authorities.

Whatever the contract with the employee, the individual entrepreneur is obliged not only to pay him a salary, but also to make contributions to the FSS and the PFR. Failure to comply with this requirement will result in severe penalties.

The Pension Fund sets the deadline for registration for employment at 30 days from the date of such.

The individual entrepreneur provides the fund with a package of documents:


If the transfer is delayed by 90 days, the individual entrepreneur will be fined 5 thousand. After this period, the fine is doubled.

Another authority where you need to transfer information about a new employee for registration is the Social Insurance Fund. Here they put forward less loyal terms - 10 days from the date of conclusion of the employment contract.

From the documents you need:

  • certificate of entrepreneurial activity;
  • application for registration of a new employee;
  • document on tax accounting;
  • a work book filled in by the employer with the entered data on the new position;
  • an employment contract (it can also be a civil law contract if provisions on insurance were included in it);
  • you may need a certificate of availability of a bank account.

These procedures are one-time, they are carried out only when the first employee is employed. In the future, you only need to draw up personnel documents and sign an agreement with new employees.

The penalty for delaying the provision of securities to the FSS for individual entrepreneurs is 5-10 thousand.

According to the provisions of the current legislation, an individual businessman is not required to strictly comply with the procedure for personnel workflow using standard forms of documentation. These forms are given in the Decree of the State Statistics Committee No. 1 of January 5, 2004.

However, personnel experts and lawyers recommend keeping a minimum set of forms for hiring people. In the course of state inspections, this will minimize claims from controllers and help resolve labor disputes.

The correct recruitment of a person for a position must be carried out in several stages:


Obtaining documents from an employee who is getting a job:

  • identity card - as a rule, an all-Russian passport, or other document;
  • employment history. In situations where a citizen has not worked before, the individual entrepreneur assumes the obligation to establish it, and if a person gets a part-time job, the book is not needed;
  • SNILS. If there is none (first employment), you will have to issue an insurance certificate too;
  • documents of an employee on military registration, if he is liable for military service and by age can be called up for service;
  • certificates of education of the employee, his qualifications, the availability of special knowledge, if the type of activity performed requires special skills and knowledge.


This is followed by the employee writing an application for admission. A person writes an IP application, where he asks to accept him for the desired job, in the prescribed form (see the sample above). The requirement is not mandatory, but highly recommended.

After the candidate is approved for work, a contract is concluded with him. The paper is written in two copies, one of which is given to the employee.

The document fixes:

  1. Terms of payment.
  2. Job responsibilities.
  3. If there is a job description, a reference is made to it.

At the end of the document, the citizen puts his signature on the fact of receiving a copy of the contract and familiarizing himself with it. Also, if there are regulatory local acts (regulations on labor protection, personal data, trade secrets, etc.), the new employee is familiarized with those against signature.

When the employee is accepted, the individual entrepreneur draws up an acceptance order for him on the same date that appears in the contract, possibly later, but not earlier. The citizen must read the order and sign it.

Making a personal card. The employee card is entered in the T-2 form. An individual entrepreneur is not required to comply with this rule, but it is still advisable to do this - for the reasons indicated earlier.

After completing all the formalities, an entry is made in the work book of a person about a new workplace and position. The individual entrepreneur is obliged to do this within a week (as well as to get a book, if there was none).
