Application for leave - how to write for the next, at your own expense, maternity or child care

Russian labor legislation considers several types of vacations: regular, educational, additional. Often, for such a release from work, it is necessary to correctly write an application for leave with a request to provide it at a certain time. This can be done by hand on A4 paper or on a letterhead, having agreed in advance with the head of the vacation period. It is important to obtain the written consent of the director (visa on the application), which will be the basis for the preparation of the relevant order.

Vacation types

In accordance with labor legislation, vacation periods are divided into several categories - according to the circumstances of provision, duration and features of payment. Chapter 19 of the Labor Code of the Russian Federation distinguishes the following types:

  1. Annual basic paid - with a standard duration of 28 days (may be longer for some categories of employees) is provided according to the approved schedule.
  2. Annual additional paid - according to Article 116 of the Labor Code of the Russian Federation, it is due to employees with special working conditions (for example, in the Far North).
  3. Educational - provided to students during training on the basis of a certificate-call. A prerequisite is the presence of State accreditation at the educational institution.
  4. Without pay - given for good reasons (for example, family or personal circumstances) and it is unpaid.
  5. Maternity leave (for pregnancy and childbirth) - they receive by presenting a certificate of incapacity for work, and this break has a period of 140 days.
  6. For child care - can be used by both the mother and father of the baby, as well as other relatives who have written an application for leave. This work break is included in the length of service.

How to write a leave application

Since the vacation application is a business document, you should be very careful when filling out. Simple rules will help to correctly compose this paper:

  • The leave application form can be free-form - it can be handwritten or typed on a computer, but the applicant's signature must always be handwritten.
  • In the upper right corner of the sheet is the header of the document. First, the position of the head, full name is written. The position of the applicant, full name is indicated below. The text should look something like this: “To the General Director of PromInnovatsiya Alekseev M.S. from the chief engineer Ivanov P. M. ".
  • The title of the document is written next - the word statement with a lowercase letter in the middle of the line.
  • The text implies an indication of the type of leave, reasons and specific dates may be required.
  • At the end of the application put the date, the signature of the applicant and in words - the full name of the person who wrote it.

Terms of writing

The current labor legislation does not say anywhere about the deadlines for submitting a vacation application, but this requirement can be enshrined in the company's local regulations. In any case, according to the Labor Code of the Russian Federation, the accounting department must calculate vacation pay no later than 3 days before the start of the vacation period (with the exception of special cases). From this it is clear that the employee must submit an application 4-5 days before the break from work begins.

The easiest way to prepare such a document is to download a standard form and supplement it with the necessary information. Another option is to prepare the text yourself using a unified header and header format, adding the base text, taking into account specific circumstances. When submitting a ready-made application for paid leave (or other type of break from work), keep in mind that, by law, it must be supported by an order from the director.

Another paid

The time of such a rest is fixed in the vacation schedule, but there are situations when it is necessary to write an application for the next vacation (for example, for a new employee). In this case, the type of vacation period and dates are indicated in the base text - it may look like this: “I ask you to provide me with another paid vacation from 11/1/2017 to 11/28/2017”. If the entire period is used, then the completion date can be omitted; with a partial one, it is better to write the duration.

Additional

The basic text in this case does not change very much, and will be something like this: “Please provide me with an additional paid leave of 12 days from 12/1/2017 to 12/14/2017.” At the request of the employee, you can specify the grounds for the vacation period (for example, for employees of the Far North who have the right to 24 additional calendar days: “... provide in accordance with Article 312 of the Labor Code of the Russian Federation ...”), but you can do without it.

Extraordinary

In a situation where an employee does not go on vacation according to the schedule, he must write an application for vacation out of turn / plan. Another reason for such a statement is that only the month is indicated in the schedule, without more specific information. When filling out an application, the employee must indicate the start time, end time, and duration of rest. For example, it could take the following form: “I ask you to provide me (outside the schedule) with a part of the main paid leave lasting 14 days from 11/1/2017 to 11/14/2017.”

Administrative at own expense

A vacation period without pay can be at the initiative of the employee or employer. In the first case, the employee has the right by law to such a release from work (the relevant article of the Labor Code of the Russian Federation is indicated in the application) and they cannot but let him go. In the second situation, the employee gives a reason, but the director may refuse, citing a production need. An example of registration: “I ask you to provide me with a vacation at my own expense from 12/15/2017 to 12/20/2017 due to the birth of a child with my daughter.”

Application for maternity leave

This holiday period begins at the 30th week of pregnancy and, in the absence of complications, lasts 140 days. In addition to asking for a break, the expectant mother can provide details for transferring benefits. Sample base text: “Please grant me maternity leave from 04/01/2018 to 08/17/2018 and pay me the allowances due. Requisites for transfer: Sberbank card No. 2334 4332 4556 6554.

For child care

The duration of this break in work is until the child reaches three years of age. The main text for the application will be something like this: “I ask you to provide me with a vacation period from November 1, 2017 to care for a child - Ivanov Maxim Petrovich, until he reaches the age of 3 years. Please transfer the necessary benefits and compensation payments to the Sberbank card No. .... ". The completed application must be accompanied by a birth certificate of the child and a certificate from the work of the second spouse that he is not given a similar allowance.

Study leave application

Receipt of a study leave implies the submission of a reference-call to the personnel service. The content of the basic part in this case may be as follows: “In connection with studying at Moscow State University, I ask you to provide me with educational paid leave from 01/15/2018 for a period of 14 calendar days. A certificate from educational institution No. 221-32 is attached.”

academic leave

Such a break is provided to students who, for certain reasons, are temporarily unable to continue their studies. These reasons include medical reasons (including pregnancy), family circumstances, conscription into the army. The basic text is as follows: “In accordance with Article 34 of the Law “On Education”, I ask you to provide me with a vacation period from September 1, 2018 in connection with conscription for military service. The summons from the military registration and enlistment office is attached.

How to apply for a vacation rescheduling

According to Article 124 of the Labor Code of the Russian Federation, the transfer of the annual paid vacation period is allowed (in this case, the reasons for the transfer can also be given in local regulations). In this case, the employee in the application indicates the previous and expected dates of the break in work, justifying the need for this. For example: “I ask you to transfer my annual paid leave from 11/1/2017 to 12/1/2017 due to the combination of the vacation period with my spouse.”

Preparing an application of this type is not difficult, and the employee can count on an annual paid vacation or break at his own expense (but in the latter case this is not the responsibility of the director and he may refuse). Sample basic text: “I ask you to provide me with annual paid leave from 11/1/2017, followed by dismissal.”

Application for compensation for unused vacation

By law, every employee has the right to receive leave or monetary compensation for it. Payments can also be made for part of the vacation time or an additional period. The main text of the application is drawn up as follows: “In accordance with Article 126 of the Labor Code of the Russian Federation, I ask you to replace the additional 14-day leave due to me from November 1, 2017 to November 14, 2017 with monetary compensation.”
