"The recommended minimum salaries for employees of cultural and art institutions are established on the basis of assigning the positions of employees they hold to the PKG by orders of the Ministry of Health and social development Russian Federation of August 31, 2007 N 570 "On the approval of professional qualification groups for positions of workers in culture, art and cinematography" (registered with the Ministry of Justice of the Russian Federation on October 1, 2007 N 10222), dated May 29, 2008 N 247n "On approval professional qualification groups for positions of managers, specialists and employees" (registered in the Ministry of Justice of the Russian Federation on June 18, 2008 N 11858).

Question: ... By orders of the Ministry of Health and Social Development of Russia dated August 31, 2007 n 570 and dated 03/14/2008 n 121n, professional qualification groups (PCG) were approved for positions of employees and professions of workers in culture, art and cinematography, in which more than a hundred names of positions and professions were not reflected applied on the territory Khabarovsk Territory. Question: Orders of the Ministry of Health and Social Development of Russia dated August 31, 2007 N 570 and dated March 14, 2008 N 121n approved professional qualification groups (PCG) for positions of employees and professions of workers in culture, art and cinematography, which did not reflect more than a hundred names of positions and professions used in today on the territory of the Khabarovsk Territory in accordance with applicable documents. The legislation does not provide for independent decisions of the subjects of the Russian Federation in matters of establishing (supplementing, amending) normative acts approved by the federal executive body that performs the functions of developing state policy and legal regulation in this area. This slows down and complicates the process of developing and introducing qualitatively new sectoral wage systems. How to be?
Answer: In accordance with Art. 144 of the Labor Code of the Russian Federation, remuneration systems for employees of state and municipal institutions are established taking into account the Unified Tariff and Qualification Handbook of Works and Professions of Workers, the Unified Qualification Handbook for the Positions of Managers, Specialists and Employees, as well as taking into account state guarantees for wages, recommendations of the Russian Tripartite Commission on regulation of social and labor relations (part 3 of article 135 of the Labor Code of the Russian Federation) and the opinions of the relevant trade unions (associations of trade unions) and associations of employers.
Note. Unified qualification guide for education and healthcare
By order of the Ministry of Health and Social Development of Russia dated November 6, 2009 N 869, the Unified Qualification Handbook (EKS) for the positions of managers, specialists and employees, the section "Qualification characteristics of positions of workers in the healthcare sector" was approved.
Order of the Ministry of Health and Social Development of Russia dated October 30, 2009 N 858 approved the Unified Qualification Directory for the Positions of Managers, Specialists and Employees, the section "Qualification Characteristics of the Positions of Managers and Specialists of Higher Professional and Additional Professional Education".
Vocational qualification groups - groups of professions of workers and positions of employees, formed taking into account the field of activity on the basis of the requirements for professional training and the level of qualification that are necessary for the implementation of the relevant professional activity.
Proceeding from this, professional qualification groups are formed taking into account the Unified Tariff and Qualification Directory of Works and Professions of Workers and the Unified Qualification Guide for the Positions of Managers, Specialists and Employees.
The professional qualification groups of industry-wide professions of workers, approved by the Order of the Ministry of Health and Social Development of Russia dated May 29, 2008 N 248n "On approval of professional qualification groups of industry-wide professions of workers", include the professions of workers of all editions of the Unified Tariff-Qualification Reference Book of Works and Occupations of Workers.
It should be borne in mind that the staffing of a cultural institution may include the professions of workers and the positions of managers, specialists and employees not only from the PKG of the professions of workers and the PKG of the positions of workers in culture, art and cinematography, but also from any other field of activity.
For example, the positions "research officer; senior researcher; leading researcher; scientific secretary" are included in the professional qualification groups for positions of workers in the field of scientific research and development, approved by Order of the Ministry of Health and Social Development of Russia dated July 3, 2008 N 305n "On approval of professional qualification groups for positions of workers in the field of scientific research and development".
The names of non-existent positions of employees and professions of workers, for example, "head of other structural divisions of the institution", "head of the center", "head of the site", "head of the studio" and a number of others, should be brought into line with the Unified Tariff and Qualification Directory of Works and Professions of Workers and Unified qualification directory of positions of managers, specialists and employees.
