Some clarifications on Article 12.15. given to the Department of Security traffic Ministry of Internal Affairs of Russia:
Situation 1 - overtaking in the opposite lane. The situation is clearly spelled out in part 4 of article 12.15. For such a violation, there is an uncontested deprivation of the right to drive for a period of 4 to 6 months. Situation 2 also qualifies under part 4 of article 12.15. When turning left, drivers often start the maneuver before reaching the broken line. The explanation is simple - there was a meter or two left before the gap in the continuous, but I want to have time to slip under the burning arrow. But in fact, the driver enters the lane of oncoming traffic. And thus creates a dangerous situation. After all, another car could leave the turn towards. The saved meter at the turn will also leave the violator without the right to drive the transport without options.
Situation 3 - the only lane of the road was blocked by a standing car. It is necessary to go around such an obstacle on the right. But if this is not possible, then you can go around it on the left, after giving way to oncoming vehicles. And the traffic police inspector should not punish the driver for such a continuous intersection and exit into the oncoming one. But if it was possible to go around the obstacle on the right side, and the driver decided that it would be faster or easier on the left, then he will have to answer under part 3 of article 12.15 - driving into the oncoming lane, connected to the bypass of the obstacle. For such a violation, a fine is imposed - from 1000 to 1500 rubles.
Situation 4 - a reversal through a solid line. If the driver turned around through a continuous one, then he "made a departure in violation of traffic rules to the side of the road intended for oncoming traffic, connected with a U-turn." He faces liability under part 3 of Article 12.15. But this is not a deprivation of rights, but a fine of 1000 to 1500 rubles.
Situation 5 - turn left through the solid. In such cases, the driver crosses the solid line and the oncoming lane. And falls under part 3 of article 12.15. Such a violation is considered to be driving into the oncoming lane, combined with a left turn. It is punishable only by a fine of 1000 to 1500 rubles.
Situation 6 - exit from the yard or from the alley to the street with two-way traffic. If there is a solid line on it, then a left turn will be a gross violation. The driver will have to answer under article 12.16 - for non-compliance with the requirements prescribed by road signs or markings. For this violation, a fine of 100 rubles is provided.
Situation 7 - if on a two-lane road the driver went to overtake in the opposite direction, but in the area of the "Overtaking prohibited" sign, this violation will be qualified under part 4 of article 12.15. For overtaking with a trip to the oncoming lane in the area of such a sign, through the court they will be deprived of their rights for 4 - 6 months. Part four of Article 12.15 does not provide for another punishment. Even in the case when temporary signs are installed on the road.
Situation 8 - rules prohibit overtaking at level crossings and closer than 100 meters in front of them. Such overtaking in the opposite lane will also be qualified under part 4 of article 12.15, which provides for the deprivation of rights for 4-6 months.
Situation 9 - overtaking into the oncoming lane at the end of the climb and in other areas with limited visibility. Even if there are no signs in these areas, but visibility is limited, the inspector has the right to qualify this violation under part 4 of article 12.15. Such rigidity of this norm is justified - there are more than enough victims of just such a violation on the roads.
Situation 10 - we have already described situation 2, when the driver did not reach the gap in the markings to make a left turn, i.e. drove to the turn in the oncoming lane. In the same way, that is, deprivation of the right to drive for a period of 4 to 6 months, the case is punishable when the driver drove in the opposite direction on the street he turned into. The Rules of the Road say that "the turn must be carried out in such a way that when leaving the intersection of the carriageways, the vehicle does not end up on the side of oncoming traffic."
Situation 11 - deprivation of rights under part 4 of article 12.15 of the Code of Administrative Offenses is also punishable by driving through a continuous lane into the oncoming lane intended for traffic public transport.
Situation 12 - if the driver has entered the lane for public transport and is moving in the direction in which buses with trolleybuses should go along this lane, then the responsibility is under article 12.16 for non-compliance with the requirements prescribed by road signs or markings. For this violation, a fine of 100 rubles is provided.
