1. The procedure for reimbursement to municipal specialized funeral services (hereinafter referred to as municipal specialized services) for the cost of a guaranteed list of services for the burial of the dead was developed in accordance with the Federal Law “On Burial and Funeral Affairs”, Decree of the President Russian Federation dated June 29, 1996 No. 1001 “On Guarantees of the Rights of Citizens to Provide Services for the Burial of the Dead” and regulates the procedure for reimbursement of municipal specialized services at the expense of the budget of the city of Novosibirsk in the amount of the difference between the cost of services provided according to the guaranteed list established by the legal act of the mayor, and the cost of compensation in accordance with the legislation of the Russian Federation and the Novosibirsk region.

2. Financing of the expenses specified in paragraph 1 of this Procedure is carried out at the expense of the budget of the city of Novosibirsk, provided for these purposes in the current financial year.

3. The expenses associated with the provision of a guaranteed list of burial services are subject to reimbursement to municipal specialized services, in the part exceeding the amount of reimbursement of the cost of services by the Pension Fund of the Russian Federation, the Fund social insurance Russian Federation, as well as from the federal and regional budgets, for the burial of the following categories of the dead:

who do not have a spouse, close relatives, other relatives or legal representative of the deceased;

registered on the day of death with the bodies of social protection of the population at the place of residence.

4. The amount of expenses reimbursed to municipal specialized services at the expense of the budget of the city of Novosibirsk for one burial is determined as the difference between the cost of services provided according to the guaranteed list established by the mayor's legal act and the cost of reimbursement of these services established by the legislation of the Russian Federation and the Novosibirsk Region

5. Expenses associated with burial shall not be reimbursed to municipal specialized services in the following cases:

5.1. Payment of the cost of the guaranteed list of burial services at the expense of the spouse, close relatives, legal representative of the deceased or other persons who have assumed the duties of burying the deceased.

5.2. Receipt of social benefits for burial by a spouse, close relative, legal representative of the deceased or another person who has assumed the responsibility for burying the deceased.

6. Municipal specialized services, no later than the 15th day of the month following the reporting month in which the burial of the dead, submit to the Novosibirsk City Hall in duplicate documents in accordance with Appendix 1, confirming the volume of burial services provided, indicating the categories of the dead and the costs to be reimbursed.

7. City Hall of Novosibirsk:

7.1. Ensures the issuance of a certificate to the spouse, close relatives, other relatives, legal representative or other person who has assumed the obligation to carry out the burial of the deceased, that the deceased was registered with the body on the day of death social protection population. The certificate is issued by the body of social protection of the population at the place of residence of the deceased.

7.2. Concludes agreements with municipal specialized services for reimbursement of expenses specified in paragraph 3 of this Procedure (Appendix 2).

7.3. Transfers funds to municipal specialized services within the limits of budget obligations and estimates of income and expenses for the current fiscal year. The transfer of funds to municipal specialized services is made within seven days from the date they provide documents confirming the actual expenses incurred, in accordance with the concluded agreements.

5.1. Any changes and additions to this agreement are valid only if they are executed additional agreement to the contract and signed by both parties.

5.2. The amendments and additions made are considered by the parties within two weeks from the date of their receipt.

6. Procedure for resolving disputes

6.1. In case of disputes regarding the execution of the contract, the parties have the right to apply to Court of Arbitration Novosibirsk region.

6.2. Making a claim is mandatory. The review period is 30 days.

7. Other terms

7.1. This Agreement is drawn up and signed in duplicate, having equal legal force, one copy for each party.

7.2. To the extent not regulated by this agreement, the relations of the parties are governed by the legislation of the Russian Federation and the Novosibirsk Region.

7.3. Neither party has the right to transfer its rights and obligations under this agreement to third parties without the written consent of the other party.

7.4. When the address changes, the parties undertake to notify each other of such changes. Otherwise, messages, claims sent to the last known address are considered to be sent properly.

8. Addresses, details and signatures of the parties

A specialized funeral service may be given, in the prescribed manner, refundable working capital in the amount necessary for the provision of these services within a month, at the expense of the budget of St. Petersburg.
2. The cost of services provided in accordance with the guaranteed list of burial services provided for in paragraph 1 of this article is determined by the Administration of St. Petersburg in agreement with the relevant departments of the Pension Fund of the Russian Federation and the Social Insurance Fund of the Russian Federation.
The cost of these services is reimbursed to the specialized funeral service within ten days at the expense of:
Pension Fund of the Russian Federation - for the burial of deceased pensioners who were not working on the day of death;
of the State Employment Fund of the Russian Federation - for the burial of deceased non-working pensioners who prematurely issued a pension at the suggestion of the employment service (in the event that the death of a pensioner occurred during the period of receipt early retirement until they reach the age that gives them the right to receive an appropriate pension). Settlements with a specialized funeral service for the burial of deceased non-working pensioners who have issued a pension ahead of schedule at the suggestion of the employment service are carried out by the Pension Fund of the Russian Federation with subsequent reimbursement of expenses Pension fund the Russian Federation at the expense of the State Employment Fund of the Russian Federation in the amount determined in accordance with this clause;
the Social Insurance Fund of the Russian Federation - for the burial of deceased working citizens and deceased minor family members of working citizens;
the budget of St. Petersburg - in the part exceeding the amount of compensation established by the legislation of the Russian Federation by the above funds;
Petersburg budget - in cases where the deceased did not work and was not a pensioner, as well as in the event of the birth of a dead child after 196 days of pregnancy.
3. Payment for the cost of services provided in excess of the guaranteed list of burial services, or additional payment for the provision of services and ritual items more than High Quality is made at the expense of the person who has assumed the obligation to carry out the burial.
4. Persons who have received services in accordance with paragraph 1 of this article shall not be paid social benefits for burial.
5. Institutions and organizations that carry out the initial registration of the fact of death, a specialized funeral service are obliged to ensure that the persons who have undertaken the organization of the burial are informed of their right to receive services free of charge in accordance with paragraph 1 of this article.
Failure to provide free of charge services provided for by the guaranteed list of burial services, as well as failure to pay social benefits for burial, entails liability under the legislation of the Russian Federation.

The law "On the funeral business" was adopted in 1996 and has not changed since then. It provides for the possibility of a free burial, but the obligation to comply with this clause is lost in paper bureaucracy, from which gray schemes originate, when you have to pay “out of pocket” for a “place in the sun” in a cemetery.

The know-how proposed by the president involves the design required documents for burial and provision of a “guaranteed list” ritual services according to the principle of "one window" - using SNILS and without additional collection of documents.

What is a "guaranteed list"?

The federal law of 1996 "On Burial and Funeral Business" states that the guaranteed list of funeral services includes: paperwork, provision and delivery of the coffin, transportation of the body (remains) of the deceased to the cemetery (crematorium), burial (cremation followed by issuance of an urn with ashes).

What is wrong with the "funeral case" now?

Everything seems to be so, but relatives often pay money to “gray agents” for burial services. Their market control management estimates the president at 120-150 billion rubles a year. Moreover, depending on the region and the rules for processing documents, the list of services itself, and their cost today vary greatly. For example, according to local Moscow laws, you can reserve a place in a cemetery in advance, but in fact - buy it. In St. Petersburg, this can be done only with a death certificate. And this creates an unhealthy excitement in such a sad business as a funeral. After a call from a mobile phone to a cemetery, strangers begin to call you and offer a variety of funeral services.

Will the government help?

These are the poor, whose income is below one living wage. They are entitled to a one-time payment of 6,790 rubles for burial and 4,382 rubles for cremation. As of June 1, 2017, such assistance was provided 427 times in St. Petersburg for a total of 2,369,000 rubles. The second group in St. Petersburg - "blockade survivors, juvenile prisoner of camps, etc." (if the income is below two living wages). Lump sum payment in this case - 8917 rubles. As of June 1, 2017, it was used 610 times for a total of 5,222,000 rubles. In addition, you can receive compensation from the city for the funeral. The allowance is 5562 rubles.

How much does it cost "in full"?

By law, the very place in the cemetery should be provided free of charge. True, where these places are. The list of cemeteries with permitted burial is very limited, and there is no information about their condition in open sources that is understandable for any old woman.

In St. Petersburg, the Southern and Kovalevskoye cemeteries are most often offered as a burial place. Preparation of "free space" costs 19 thousand rubles there. Ritual items (coffin, wreaths, etc.) cost at least 6.5 thousand. Morgue services for preparing the body for burial - in the region of 9 thousand rubles. Catafal transport costs 6,000 kopecks. At least the entire range of services totals 40 thousand rubles. There is no maximum.

History and present of "private cemeteries" in Russia.

The President spoke about "private cemeteries" as a way to deal with funeral crime. Private cemeteries existed before the 1917 revolution. For example, during the defense of Sevastopol in 1854-1855, some people were buried in a private cemetery, which was later partially moved, and the cemetery was reclaimed. Now special areas have been allocated for cemeteries, taking into account sanitary zones, the location of reservoirs, settlements and so on. And these sites are no longer enough. Experts say that new "private cemeteries" in St. Petersburg simply have nowhere to appear. And if they decide to create them, then it will be the Leningrad region.

From whom to take an example?

As it turns out, there are attempts to create a "single window" at the cemetery in Russia. And IT-technologies come to the rescue again, without the Internet, nowhere. On the territory of Moscow and the Moscow region mobile app An "honest agent" that allows you to select a cemetery online, arrange a site on it, order transport, funeral goods, receive an agreement and pay for all these services. IT companies say that on average they complete about 500 orders per month using online schemes. In St. Petersburg there is the “Official website of the Unified City Dispatch Service of Funeral Services” (http://egds-spb.ru), where a comparative analysis of the prices of different companies is carried out, tips on identifying fraudsters and a call to report all funeral oddities to the creators of the resource.

Who will put in order the "gray schemes"?

Of course, the Prosecutor General's Office and the Ministry of Internal Affairs. The day after the news about the president's order, it became known that these departments would conduct a comprehensive audit of the funeral services sector, based on the results of which they would have to draw up a fight plan. In addition, at the behest of the president, who is considering whether to go for a new term, the existing and abandoned cemeteries will be inventoried and the same “single approach” to the provision of ritual services throughout the country will be created. Which of the existing players in the ritual market will win and who are the new players who will come after the changes is still unclear.

In the shadow

Until inspections of cemeteries have become widespread, it is not easy to find out about the shadow cemetery business. However, there are cases of coming out of the shadows. For example, in Yekaterinburg, an ex-caretaker of cemeteries, accused of embezzling more than 2.1 million rubles under the pretext of organizing burial services, will appear before the court. The prosecutor's office of Yekaterinburg approved such an indictment in June. In Moscow, cemetery employees will face trial on charges of taking bribes for providing burial sites where there is nowhere else to bury. We are talking about a reward in the amount of 400 thousand rubles.

If the legislative ban on the transfer, for example, of fraternal military graves is lifted, then "cemeteries can be built up throughout the country." Large cities have a huge number of territories - necropolises, which occupy tens of hectares. “The lifting of the ban is being lobbied by builders. The second group of lobbyists are the funeral directors, who, declaring that there is no land for burial, want the introduction of the “European scheme”, according to which, after 20 years, relatives either pay for the burial, or a reburial with cremation is carried out to free the territory and further bury other people,” said "Fontanka" Alexander Nesmeyanov.

Each of us should know that all spheres of human life in a legal society are regulated by certain legislative norms. The guaranteed list of burial services is no exception. To leave this mortal world with dignity is the constitutional right of every citizen of our country. That is why the relatives and friends of the deceased, on whose shoulders the honorable mission of organizing the funeral is entrusted, should know that today there is a list of services that are provided government bodies and structures free of charge.

Unfortunately, quite often unscrupulous employees of funeral agencies of dubious quality offer us services that are free for quite a lot of money, which makes the final cost of funeral services an unbearable burden for many of us. Knowledge of some legal framework will help you avoid unnecessary expenses, which will already be a lot in the mournful moments of farewell to the deceased. So, each of us should know that there is a list of services defined by law, which is provided to funeral organizers absolutely free of charge:

  • registration of all necessary documents for the burial;
  • provision and transportation of the coffin and the necessary minimum of ritual items;
  • providing, at the request of the organizers, a place in the cemetery;
  • transportation of the remains to the morgue or crematorium;
  • cremation or burial.

Thus, we can say that there is a guaranteed minimum that the state will provide to the relatives or friends of the deceased free of charge in any case, regardless of their financial situation. These services have their own cost, which will be reimbursed by the state structures to the funeral service, which organized the funeral. A guaranteed list of burial services, therefore, will certainly and without fail be received by every citizen of our country, regardless of social status or financial situation. To be worthy buried, in our country everyone has a constitutional right.

Reimbursement for funeral expenses

If you are responsible for organizing a funeral, then you should know that there is such a thing as compensation for burial. What does this mean? This means that every funeral director has two options:

  1. Pay for all burial services in any funeral services agency that you decide to entrust this difficult mission. In the first 6 months after the funeral, you can contact one of the government agencies and receive compensation for the funeral. The amount of such compensation, of course, does not cover all the costs of burial, but it can be quite a significant help. The amount of assistance depends on the region, as the authorities local government have the right to determine the amount of compensation, but there is also a certain fixed amount, which is guaranteed by the state budget. In Moscow and the Moscow region there are also special allowances for benefits, and therefore the amount of payments can be quite impressive.
  2. Contact the relevant authorities, provide a death certificate and write an application for the provision of free (guaranteed) burial services. It is worth considering that in this case, you will receive the necessary minimum of ritual services, but you will lose the right to receive monetary compensation for burial.
