Fulfillment of labor protection requirements in the organization

These Recommendations have been developed in order to provide methodological assistance to organizations in the implementation of step-by-step departmental and public control over the state of conditions and labor protection in structural divisions and at workplaces and determine an exemplary procedure for monitoring the state of labor safety, eliminating identified violations at all levels of control.

1. General Provisions

1.1. Gradual control in the labor protection management system is the main form of control of representatives of the employer and trade unions or other representative bodies authorized by employees over the state of working conditions and safety at workplaces, production sites, in workshops, as well as over compliance by all services, officials and employees with the requirements of legislative and other regulatory legal acts on labor protection. Gradual control does not preclude departmental control in accordance with official duties managers and specialists, as well as control due to the Regulations on the committee (commission) for labor protection and the Regulations on authorized (trusted) persons for labor protection of trade unions or other representative bodies authorized by employees.

1.2. The purpose of control is to comply with labor safety requirements in the process production activities, prevention of industrial injuries, including microtraumas, production accidents, ensuring healthy and safe conditions labor, ensuring the rights of employees to labor protection, provided for by the current legislation, as well as the timely elimination of violations of the existing rules and regulations on labor protection.

2. Basic provisions of stepwise control

2.1. Step control consists in a sequential examination of working conditions and safety at 3 steps:

Stage 1 - in a team, in a department, at a site, in a shift, is carried out by a foreman, foreman (senior foreman), mechanic, power engineer (hereinafter referred to as the foreman) together with an authorized (trusted) person for labor protection of a trade union or other representative body authorized by employees (labor

2nd stage - in a structural unit (workshop, department, laboratory, etc.) is carried out by a commission appointed by the order of the head of the unit, consisting of: the head of the unit, employees of the technical services of the unit and representatives of the trade union or other representative body of the unit authorized by the employees;

3rd stage - at the enterprise as a whole, it is carried out by a commission appointed by an order - a resolution of the employer, together with a trade union committee or other authorized collective representative body, which, as a rule, includes: Chief Engineer (Technical Director), chief specialists (mechanic, power engineer, technologist, etc.), head of the labor protection service, chairman of the trade union committee or other elected public body, chairman of the committee (commission) on labor protection of the organization.

Depending on the number of employees, the number of independent units, the management structure of the organization, control can be carried out at a greater number of steps.

2.2. The management of the organization of step control is carried out by the head of the organization and the chairman of the trade union committee or other representative body authorized by the employees.

2.3. The results of the survey are recorded in the logs of the stepwise control over labor safety (hereinafter referred to as the logs) of the 1st and 2nd stages (the recommended forms of the logs are given in appendices 1 and 2); the results of the examination of the 3rd stage are drawn up in an act.

2.4. The magazines must be laced and the sheets numbered. On the last sheet of the logs there must be the signature of the head of the labor protection service, sealed.

2.5. Strikethroughs, erasures and corrections of journal entries are not allowed.

2.6. Magazines are issued by employees of the labor protection service against signature:

1st stage - master;

2nd stage - the head of the department.

2.7. The logs of each level must be presented upon request to representatives of the supervisory and control bodies and other persons exercising control and supervision over the state of labor protection.

3. Organization and procedure for conducting control

at the first stage

3.1. An inspection of working conditions and safety should be carried out daily at the beginning of work shift and then throughout the entire shift.

3.2. Subject to verification:

3.2.1. Implementation of measures to eliminate violations identified by the previous audit.

3.2.2. The state and correctness of the organization of workplaces.

3.2.3. Condition of passages and driveways near workplaces.

3.2.4. Serviceability of equipment, instrumentation, interlocks and alarms.

3.2.5. Grounding condition (visible fastening of the ground bus to equipment and apparatus).

3.2.6. Availability and serviceability of guards for rotating parts of equipment and hazardous areas.

3.2.7. The efficiency of ventilation systems.

3.2.8. Availability and serviceability of scaffolding means for working at height.

3.2.9. Availability of workplace safety instructions.

3.2.10. Availability and serviceability of tools and fixtures.

3.2.11. Condition of sites for storage of materials, semi-finished products and products.

3.2.12. Compliance with safety requirements when storing materials, loading, transporting and unloading them.

3.2.13. Availability and proper use of funds by employees personal protection.

3.2.14. Compliance by employees with the requirements set out in the instructions for labor protection and fire safety, in the production of work during the shift.

3.2.15. Compliance with electrical safety rules by employees when working with power tools, electrical equipment and in electrical installations.

3.2.16. Performance of work of increased danger.

3.2.17. Compliance with safety rules when working with hazardous, explosive and flammable substances and materials.

3.2.18. Compliance with technological regulations.

3.2.19. The presence in the hands of employees of labor protection certificates for the right to perform the relevant work.

3.3. According to the identified violations and shortcomings, the foreman and the authorized (trusted) person outlines measures, sets the deadlines for their elimination and appoints executors to eliminate violations and shortcomings.

3.4. The elimination of identified violations, as a rule, should be carried out immediately under the direct supervision of the master.

3.5. If the violations cannot be eliminated by the site, then its head must report this at the end of the inspection. senior manager memo for appropriate action.

3.6. In the event of a violation of the requirements of rules and regulations that may cause damage to the health of workers or lead to an accident, work must be suspended until this violation is eliminated, immediately notifying the head of the unit.

3.7. The results of the check are recorded by the foreman in section II of the journal of the first stage of control (Appendix 1) with the signature of the foreman, foreman, authorized (trusted) person and performer.

3.8. The foreman, with the participation of foremen, authorized (trusted) persons, daily before starting work, holds a five-minute meeting with employees on the implementation of labor safety requirements.

3.9. At the meeting, the results of the work of the site for the past day are summed up, attention is drawn to the safe performance of work and the labor protection measures scheduled for implementation on the current day.

3.10. During the work shift, the foreman monitors the observance by employees of the rules and norms of labor safety.

3.11. If a violation is detected, the foreman is obliged to warn the worker, about which an appropriate entry should be made in section III journal of the first stage (Appendix 1) with the signature of the violator and filling in all the columns of the section. In case of violations of safety rules under clause 3.5, the foreman must write a memo to the head of the unit about taking appropriate measures, for example, imposing disciplinary action on the violator or the use of measures of public influence.

3.12. The master is responsible for the correct keeping of the log of the first stage.

3.13. Every day, the foreman must report to the management of the unit on the state of labor protection at the production site.

4. Organization and procedure for conducting control

at the second stage

4.1. The commission consisting of: the head of the unit, the technologist, the authorized (trusted) person, the member of the committee (commission) on labor protection of the trade union or other representative body authorized by the collective, once a week, must check:

4.1.1. Organization and results of the work of the first stage.

4.1.2. Implementation of activities outlined by the results of previous inspections of the second and third stages.

4.1.3. Fulfillment of orders and instructions for the enterprise and division, decisions of labor protection days, meetings, meetings on labor protection issues, decisions of the trade union committee or other body authorized by employees, committee (commission) for labor protection.

4.1.4. Implementation of measures in accordance with the instructions and instructions of the labor protection service, other supervisory and control bodies.

4.1.5. Implementation of measures based on the materials of the investigation of accidents, accidents, occupational diseases and production malfunctions.

4.1.6. Condition and conformity of equipment, containers, Vehicle and technological processes requirements of labor safety standards and other regulatory technical documentation on labor protection.

4.1.7. Compliance with planned schedules preventive maintenance equipment, ventilation systems and installations, technological regimes, regulations and instructions.

4.1.11. Availability and condition of protective, signaling and fire-fighting equipment and devices, instrumentation.

4.1.12. Timeliness and quality of briefings and training of workers on labor safety.

4.1.13. Provision of workers with overalls, footwear and other personal protective equipment.

4.1.14. Providing workers with milk, medical and preventive nutrition and special soap.

4.1.15. Condition of sanitary facilities and devices.

4.1.16. Compliance with the established regime of work and rest, labor and production discipline.

4.2. The results of the check are recorded in section II of the journal of the first stage of control with the list of members of the commission.

4.3. The violations revealed during the check at the second stage of control, which cannot be eliminated immediately, are recorded in the log of the second stage (Appendix 2).

4.4. The commission outlines activities, and the head of the unit appoints executors and deadlines.

4.5. If the planned activities cannot be carried out by the forces of the unit, then its head is obliged to report this to the chief engineer (technical director) with a memo for taking appropriate measures.

4.6. A copy of the memo must be sent to the labor protection service of the enterprise.

4.7. In case of detection of violations of the rules and norms of labor protection, which may cause damage to the health of workers or lead to an accident, the commission must suspend work until the violation is eliminated.

4.8. Every week, the head of the department holds a meeting of the engineering services of the department, foremen, foremen, an asset of a representative body authorized by employees, at which they analyze the results of the inspection, the progress in the implementation of orders, instructions, plans - schedules, labor protection instructions, as well as their own decisions on previous inspections.

5. Organization and procedure for conducting control

at the third stage

5.1. Commission consisting of: chief engineer (technical director), head of the labor protection service, chief specialists, responsible persons for the supervision of facilities that are subject to the relevant rules of Gosgortekhnadzor, Gosenergonadzor, the chairman of the trade union committee or other representative body authorized by the team, the chairman of the committee (commission) on labor protection, once a month, must check:

5.1.1. Organization and results of the work of the first and second stages.

5.1.2. Implementation of the activities outlined by the third stage last month.

5.1.3. Fulfillment of orders and orders of higher authorities, instructions and instructions of supervisory and control bodies, orders and orders of the organization's management and decisions of Occupational Safety and Health Days, meetings, trade union committee or other representative body authorized by the team on labor protection, committee (commission) on labor protection of the organization.

5.1.4. Implementation of labor protection measures provided for by the collective agreement, labor protection agreement and other documents.

Organization of technical supervision over the maintenance in good and safe condition of buildings, structures and premises of divisions and the assigned territories adjacent to them in accordance with the requirements of normative and technical documentation (NTD) on labor protection, the condition of the carriageway and pedestrian roads, crossings.

5.1.9. Compliance of technological, lifting, transport, energy, heat engineering and other equipment with the requirements of SSBT standards, rules and other NTD on labor protection, availability of inspection reports.

5.1.10. Efficiency of supply and exhaust ventilation, dust and gas trapping devices.

5.1.11. Fulfillment of the schedule of preventive maintenance of all equipment, availability of communication schemes and connection of power equipment.

5.1.12. Providing workers with overalls, special footwear and other personal protective equipment, the correctness of their issuance, storage, organization of washing, cleaning and repair.

5.1.13. Provision of workers with sanitary and amenity premises, their sanitary condition and efficiency of sanitary and amenity devices.

5.1.14. Organization of medical and preventive maintenance of employees.

5.1.15. The condition of labor protection stands, their timely and correct execution.

5.1.16. Organization and quality of training and briefing of employees on labor safety.

5.1.17. Readiness of personnel to work in emergency situations.

5.1.18. Compliance with the regime of work and rest, labor and production discipline.

5.2. The results of the check are documented by an act and an entry in the journal of the second stage signed by the members of the commission and the chairman of the committee of the trade union of the checked unit. The act is stored in the labor protection service (the act is drawn up by the labor protection service).

5.3. On a monthly basis, the chief engineer (technical director) holds a Day of Labor Protection, to which the following are invited: the chairman of the trade union committee, the chairman of the committee (commission) on labor protection, chief specialists, heads of departments, specialists from labor protection and fire safety services, a shop doctor, a trade union activist or representatives of another elected body.

5.4. On the Day of Labor Protection, the results of inspections are brought to the attention of the participants, individual heads of departments and chief specialists on committed violations are heard.

5.5. Labor protection service:

Maintains and draws up a protocol on the results of the Day of labor protection;

Sends the protocol to the heads of departments and services;

Carries out control over the implementation of decisions taken on the Day of labor protection;

Reports to the chief engineer (technical director) on the implementation of protocol decisions.

5.6. Decisions made on the Day of labor protection are in the nature of mandatory execution by the heads of departments and services. On issues requiring decision-making by the head of the organization, the chief engineer (technical director) makes appropriate proposals to the head of the organization related to the need to carry out the planned activities, as well as the imposition of a disciplinary sanction on managers and specialists who have not ensured the elimination of violations.

5.7. The trade union committee or other representative body authorized by employees, based on the results of the work of the stepwise control system, has the right to hear at meetings reports on the work of shop trade union committees or other representative bodies authorized by employees on the work to implement stepwise control over the state of labor protection.

Three-step control is one of the ways to monitor the state of conditions and labor protection in the organization, labor discipline at workplaces, compliance with labor safety standards, norms, rules, instructions and other legal acts on labor protection. Its main task is:

  • implementation of a set of measures for labor protection;
  • determination of employees responsible for timely verification of the state of labor protection;
  • elimination of shortcomings identified at three successive steps.

The employer is not obliged to introduce three-stage control in the organization. However, it can become a reliable system for the prevention of industrial injuries. It should be understood that the three-stage control will give noticeable results only if the entire staff of the organization, from workers to top management, will consistently and persistently fight for the improvement of working conditions.

What you need to implement three-step control

The main condition for the organization of three-stage control is presence of a trade union or other representative body of workers in the organization. A lot depends on the chairman of the trade union in matters of labor protection. He must organize public control, manage the work of labor protection commissioners, and negotiate with the head of the organization.

  • organizes an inspection of the state of conditions and labor protection at workplaces;

Three-stage control is most relevant for large manufacturing organizations. This system is often found in enterprises where safe work organized according to the old rules developed during the Soviet era.

An example of an industry where three-step control would be effective is construction. So, the general contractor, who works with many subcontractors, cannot always fully control the order and compliance with labor protection requirements at the facility. Hence the high probability of accidents and other incidents.

However, almost all violations of labor protection can be avoided if a three-stage control is organized and carried out at each site.

How to carry out a three-step control

The organization of three-stage control is usually carried out by the head of the company, the labor protection service and the head of the trade union or other representative body of workers. Control is carried out:

  • at the first stage - at the site of the unit, in a shift or brigade;
  • at the second stage - in the unit as a whole;
  • at the third stage - in the organization as a whole.

The results of the three-stage control are reflected in the Journal of three-stage control over the state of conditions and labor protection (hereinafter referred to as the Journal of three-stage control).

First step of control

Control at the first stage daily before the start of work is carried out by site managers (foremen, site supervisors, shift supervisors) together with a member of the trade union authorized for labor protection. At this stage, you need to check:

  • whether the violations identified during the previous audit have been eliminated;
  • the state of working conditions at each workplace;
  • condition of passages and driveways;
  • the presence of protective and signal fences;
  • the presence of the necessary tools and equipment for the work;
  • security technological equipment, lifting and transport vehicles;
  • compliance with the rules for warehousing materials, blanks, fixtures;
  • the availability, serviceability and correctness of the use of personal protective equipment by employees;
  • the state of electrical safety and compliance by employees with electrical safety rules when working on electrical installations and with power tools;
  • employees have certificates, work permits, other documents for the performance of work with increased danger.

Identified violations must be eliminated immediately. This process is controlled by the immediate supervisor of the work in this area. If the violations cannot be eliminated by the site, then the immediate supervisor of the work, upon completion of the inspection, reports this to the superior. Together they will decide what actions need to be taken to eliminate errors and appoint employees responsible for their implementation.

The employee who conducted the inspection, or the head of the site, makes a record of the identified violations in the Three-Step Control Log. Under the record, the authorized representative for labor protection of the trade union or other representative body of workers must sign.

If a gross violation of labor protection is detected at the first stage of control, which can harm the health of employees or lead to an accident, then work is suspended until the violation is eliminated. At the same time, in the log of three-stage control, the inspectors make an entry that it is recommended to suspend work until the violations are eliminated.

The head of work must inform his subordinates about all discrepancies found. In addition, he daily reports on the state of labor protection at his site to a higher manager.

Second stage of control

Responsible for control at the second stage is the head of the workshop, department, construction site with the participation of a labor protection representative from the trade union. At this stage, representatives of the technical services of the unit (for example, the services of the chief mechanic, chief power engineer, chief technologist), a specialist in the labor protection service of the organization can join the check.

  • implementation of measures planned after previous inspections at the first and second stages of control;
  • implementation of orders of the head of the organization and the trade union on labor protection issues;
  • fulfillment of instructions of state supervision and control bodies;
  • implementation of measures developed as a result of the investigation of accidents;
  • serviceability and compliance of production equipment, vehicles and technological processes with the requirements of regulatory legal acts on labor protection;
  • observance of schedules of scheduled preventive repairs of mechanisms, equipment, technological modes of operation;
  • the state of labor protection in subdivisions, the presence of posters on labor protection, signal colors, safety signs;
  • availability and serviceability of protective, signaling and fire-fighting equipment and devices, instrumentation;
  • timeliness and quality of instructing employees on labor protection;
  • the availability and correct use of personal protective equipment by employees;
  • condition of sanitary facilities and devices;
  • observance of the established regime of work and rest, labor discipline.

Violations that cannot be eliminated on the spot are recorded in the Log of three-stage control in the form of comments. The head of the structural unit must organize measures to eliminate violations and once a month report to the labor protection committee on the state of conditions and labor protection in his structural unit.

The employer should create an inspection schedule for each stage of the three-stage control. This will allow inspections to be carried out on time and not to cross inspections at different levels with each other.

Third stage of control

Control at the third stage is carried out by a commission headed by the head of the organization or the chief engineer and the chairman of the trade union committee. It also includes the head of the labor protection service, technical service and an authorized safety officer from the union.

Control is carried out at least once a quarter (usually once a month), while checking:

  • organization, frequency of carrying out and results of work of the first and second stages of control;
  • keeping a log of three-stage control;
  • implementation of measures provided for by collective agreements, agreements on labor protection and other documents;
  • implementation of measures developed as a result of the investigation of severe and group accidents and accidents;
  • technical condition and maintenance of buildings, structures, premises, workshops and territories adjacent to them;
  • execution of orders and instructions, instructions and instructions of state supervision bodies;
  • provision of employees with sanitary facilities and devices;
  • organization of training and briefings on labor protection.

Based on the results of the inspection, the commission draws up an act, and the identified violations are recorded in the Journal of three-stage control of the unit in which the inspection was carried out.

In addition, the head of the organization considers the results of the third stage of control with the participation of the heads of structural divisions, chief specialists, representatives trade union organization. Together they develop measures with the help of which it is possible to eliminate the identified shortcomings and violations, and the head of the enterprise appoints the executors and the deadlines for the implementation of these measures. Minutes are drawn up based on the results of the meeting.

After that, if necessary, the head issues an order to attract disciplinary responsibility employees who have committed violations of labor protection or are guilty of unsatisfactory organization of work in this area. And vice versa: employees who have achieved positive results in work on labor protection can be encouraged.

The first level of verification takes place every day, the second - weekly, the third - every month, at its end.

Rights and obligations of authorized persons

The head of the site at the initial level of control must, at shift meetings, inform the employees about the problems detected by the inspection. violations, as well as about measures taken to get rid of them. At the end of the working day, the site manager is obliged to report to the shop authorities on the situation of labor protection at the production sites.

The head of the structure at the second stage of verification has the right to assign actions, determine the timing of their implementation and performers.
