Who and why may need a certificate of absence of IP status

In the Russian Federation, as well as in another country, any citizen who is recognized as capable and of legal age can start a private business. This is enshrined in the Constitution of the Russian Federation. A person also has the right to combine commercial activities as an individual entrepreneur and work under an employment contract with an employer.

But at the same time, it is important that a person can receive the status of an individual entrepreneur only if he does not have a legislative ban on running his own business due to his professional activity or position.

There are several legal acts that contain direct prohibitions on combining commercial activities IP and certain positions, these include:

  1. Civil servants and employees of municipalities - conducting business in parallel with the state and municipal service prohibits (with amendments that came into force on January 1, 2018), as well as Law No. 119 “On the Fundamentals of the Civil Service of the Russian Federation”. These requirements are set out in separate legislative acts, for example, in Federal Law No. 342, etc.
  4. Military personnel - persons who are in military service under a contract or by conscription. In this case, Federal Law No. 76 “On the status of military personnel” applies. Business activity for them is strictly closed.
  5. Lawyers and notaries also do not have the right to be individual entrepreneurs, although they are actually engaged in private business, they are not considered entrepreneurs (they stand apart in tax accounting).

It should be noted that not always the fact of employment in municipal organization or state institution implies the status of a civil servant. Here, the law demarcates employees and officials. This special status is established by the Decree of the President of the Russian Federation, as well as regional and municipal acts. Therefore, if, when applying for a job, a person, in addition to basic documents, is asked to bring a certificate of the absence of an individual entrepreneur registered for him, this means that the position is equated to the civil service or to one of the above categories.

All employees of the Ministry of Internal Affairs, the Federal Tax Service, the FSSP, the prosecutor's office, as well as officials and deputies do not have the right to combine their main activities and business, therefore, when hiring, they may be asked for the necessary certificate

Therefore, regulatory authorities have taken restrictions on the combination of commercial activities and direct official duties.

  • a package of documents is necessarily formed with an inventory and a delivery notification;

Regulators do not set specific validity periods for the certificate (unlike, for example, an extract from the USRIP, which is valid only for 21 days). It only depends on the requirements of the organization that requests this document.
